1. Acceptance of Terms
By accessing the Nate Adult Daycare website at natedayhab.com or by enrolling in or using any of our programs or services, you (“you,” “participant,” “guardian,” or “family member”) agree to these Terms of Service and our Privacy Policy, which are incorporated herein by reference.
If you do not agree to these terms, please do not use our website or services. We reserve the right to update these terms at any time, and your continued use of our services constitutes acceptance of any changes.
2. Services Description
Nate Adult Daycare is a licensed adult day habilitation and community-based services provider located in Houston, Texas. Our services include, but are not limited to:
- Adult Day Habilitation (weekday and weekend programs)
- IDD Plus Weekend Community Program
- Respite Care services
- Community integration and life skills activities
- Support for individuals enrolled in HCS, CLASS, DBMD, TXHML, and Respite waivers
Our services are subject to availability, program capacity, and applicable eligibility requirements. We reserve the right to modify, suspend, or discontinue any program or service with appropriate notice.
3. Eligibility & Enrollment
To be eligible for our services, individuals must:
- Reside in Texas and meet state eligibility criteria for applicable Medicaid waivers or private pay arrangements
- Have a current service authorization, Individual Service Plan (ISP), or equivalent documentation where required
- Complete our intake and enrollment process, including health assessments and required forms
- Be able to safely participate in a group day habilitation setting (with appropriate support accommodations)
Enrollment is subject to availability and our assessment of whether we can safely and appropriately meet the individual’s needs. Acceptance of enrollment applications is at the sole discretion of Nate Adult Daycare.
4. Participant & Guardian Responsibilities
Participants and their authorized guardians or representatives agree to:
- Provide accurate, complete, and current information during enrollment and throughout the service relationship
- Notify us promptly of any changes in health status, medications, emergency contacts, or authorizations
- Maintain current Medicaid waiver authorizations and provide updated documentation as required
- Ensure timely arrival and pickup for program activities
- Communicate any concerns about care or programming directly with our staff
- Treat our staff, other participants, and facility with respect
5. Payment & Billing
Nate Adult Daycare accepts Medicaid waiver funding (HCS, CLASS, DBMD, TXHML, Respite) as well as private pay arrangements. By enrolling, you agree to the following:
- You authorize us to bill your applicable Medicaid waiver or insurance program for covered services.
- You are responsible for any services, absences, or charges not covered by your waiver authorization.
- Private pay rates are provided separately and are subject to a signed service agreement.
- Billing disputes must be submitted in writing within 30 days of the statement date.
We comply with all applicable Texas HHSC billing regulations and waiver program requirements.
6. Code of Conduct
To maintain a safe and supportive environment for all participants, we expect everyone who interacts with our program — including participants, guardians, and visitors — to:
- Treat all individuals with dignity, respect, and kindness
- Refrain from verbal abuse, threatening behavior, harassment, or physical aggression
- Follow staff instructions related to safety and program procedures
- Refrain from bringing prohibited items onto the premises
Nate Adult Daycare reserves the right to suspend or terminate services for any individual whose behavior poses a safety risk to themselves, other participants, or staff, following applicable notification procedures.
7. Website Use
You may use our website for lawful purposes only. You agree not to:
- Attempt to gain unauthorized access to any part of the website or its systems
- Transmit spam, malware, or any harmful code
- Scrape, copy, or reproduce website content for commercial use without written permission
- Use the website in any way that violates applicable local, state, or federal law
We reserve the right to restrict or terminate access to the website for any user who violates these terms.

Either party may terminate the service relationship with appropriate written notice as specified in the service agreement. We reserve the right to terminate services immediately in cases involving safety concerns, fraud, material misrepresentation, or violation of applicable laws or regulations.
Upon termination, we will assist with transition planning in accordance with applicable state waiver requirements and ensure continuity of care where possible.
12. Governing Law
These Terms of Service are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the state or federal courts located in Harris County, Texas, and you consent to the jurisdiction of such courts.
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
